How Do You Spell Apology?

I told you so.

For the last five years, I’ve been telling you that Frank Guinta was lying to us about his magic bank account. After an interminable FEC investigation, we learned this week that Frank DID break campaign finance laws by using his parent’s money to fund his campaign in 2010. He has to pay back the $355,000 he claimed he earned himself. He’s being fined $15,000. The Patriots are paying a million dollar fine for some deflated balls. Frank Guinta is being fined $15,000 for breaking campaign finance laws and betraying the public trust.

 In 2010, Frank Guinta, former mayor of Manchester, ran for Congress against incumbent Carol Shea-Porter. Over the course of the campaign, he loaned himself $355,000. It was done incrementally. In 2010 after one such incremental “loan”, a Nashua Telegraph reporter wondered, in print, where he’d gotten all that loan money. Twelve days later, Guinta filed a revised financial disclosure form that added a new bank account worth somewhere between $250,000 - $500,000. (The bank account had not appeared on previous disclosure forms.) He also altered the period of disclosure on the form, adding an additional 4 months. It seemed obvious that the account had been opened during that time, given his refusal to provide a bank statement.

When he was asked where the money came from, he said he earned it. He told the Union Leader that he’d begun putting money away in the mid-1990’s. The only problem was that his known assets and income – no matter how frugal he was – did not add up to him being able to save that kind of money.

In 2008, his parents sold a house in New Jersey for $820,000. It seemed obvious that they were the source of the mystery money, which he denied. For five years.

In July of 2010, Guinta’s campaign manger, Mike Biundo, said that Guinta had liquidated some of his stock market and mutual fund assets. Guinta said that Biundo had made a mistake, and he’d always had that money in a bank account he’d forgotten about. It’s so easy to misplace half a million dollars when you’re running for office.

In October, 2010 the Union Leader reported that Guinta denied accepting money from his parents to finance his campaign and that Carol Shea-Porter and the Democrats had stooped to a new low for implying he had.

Former GOP Congressman Jeb Bradley had been Guinta’s boss when Bradley was in Congress. He did not ever endorse his former staffer; in fact, he told Politico that if Guinta couldn’t account for the money he should withdraw from the race.

Fergus Cullen, former NHGOP Chair, wrote a piece for the Union Leader in August 2010, about the mystery money. He asked Guinta how he could have forgotten to list a bank account worth half a million in his previous disclosure forms. Guinta called it an “inadvertent oversight.”

He continued to insist that he earned the money, that his parents did not help him. A GOP activist filed the first complaint and later the NHDP also filed a complaint with the FEC. That complaint was filed in September 2010.

Guinta won the 2010 election, despite the questions about his finances. During the campaign he made a lot of noise about Congresswoman Shea-Porter abusing Congressional franking privileges. Frank went on to become the #1 abuser of the franking system for the 2011/2012 Congress, sending out big, shiny, multicolored mailers every week.  The group Citizens for Responsibility and Ethics in Washington named Guinta one of the most corrupt legislators of the year.  He lost the 2012 election.

In 2014 Guinta ran again. He ran an ad featuring his mother and his wife, who assured voters that Saint Frank would be there for all of us. He ran an ad featuring “real NH voters.” The last woman in the ad said, “He’s always been honest.” In October the DCCC (Democratic Congressional Campaign Committee) ran a couple of ads asking where the mystery money came from.

On October 27, 2014, WMUR televised a debate between Guinta and Shea-Porter. I was there. When Shea-Porter asked about the money, Guinta said he’d been cleared by the FEC, in Dec. 2010, before he was even sworn in, and he had been exonerated. He accused Carol of lying about his record, and huffily announced, “The people of NH ought to know the truth.” 

Then his campaign ran an ad called “The Truth.” The ad accuses Carol Shea-Porter of lying about Guinta’s finances. The ad claims Guinta was cleared 100% by the House Ethics Committee on 12/14/10. Again, before Guinta was ever even sworn in for his first term. The thing is, the House Ethics Committee never investigated him. He approved that ad.

At the debate he said he’d been cleared by the FEC. In the ad he claimed to have been exonerated by the House Ethics Committee. He knew both of those things to be untrue, but he didn’t hesitate to trumpet them loudly. The people of NH certainly deserved the truth, but Guinta was the last person they were ever going to hear it from.

This week, the FEC finally found him guilty of violating campaign finance laws. He has to pay the $355,000 back. He has to pay a $15,000 fine. He now claims that he had access to his parent’s account (which is in their names, not his) and had made deposits into it that exceeded the amount he “loaned” his campaign. He says he’s come to an agreement with the FEC so he can “end the distraction.” Those big, bold-faced lies he told during the WMUR debate? He’s trying to say he “misspoke.”

For 5 long years, Frank Guinta told us that he earned that campaign money; his parents didn’t give it to him and he put it in a bank account he forgot about. He accused Carol Shea-Porter of lying about his finances in a televised debate. He NOW says that he “inadvertently” made a mistake on his FEC forms. He NOW apparently “misspoke” when he accused Carol Shea Porter of lying about his finances.

How can he repay the voters of his district for 5 years of lying? How can he repay the state for stealing an election? How is it possible that NH Republicans are silent about this? Where is his apology to Carol Shea-Porter for those ugly, dishonest accusations he made?

There’s only one way out.  

For Frank Guinta, apology is spelled: R-E-S-I-G-N-A-T-I-O-N.

Frank Guinta Still Under Investigation by the FEC

Remember this attack ad from October 2014? Frank Guinta claims Carol Shea Porter is LYING about him. He claims he's been cleared by the House Ethics Committee.

Here's the thing - Guinta was never under investigation by the House Ethics Committee. His transgression (the $355,000 magic bank account that funded his first run for Congress) occurred before he was elected. The investigation Frank is trying to deny is being conducted by the Federal Election Commission. (FEC). 

Here he is again, bleating about being a victim, claiming he was exonerated, during a televised debate on WMUR. He accuses Carol of lying. 




Guinta claimed that money was in a bank account he "forgot" about. Hell, who among us hasn't forgotten about over a quarter of a million dollars?

He's refused to explain where the money came from. One would think that he'd be able to produce a bank statement to clear it all up. One would think he'd want to clear this up. One would be wrong.

Guinta's first campaign featured a lot of wailing about alleged abuses by Congresswoman Shea-Porter of the House franking system. Guinta went on to become the largest abuser of that same franking system:  "Also among individual House members, Rep. Frank C. Guinta, R-N.H., spent the most on franked mail in 2011: $164,650."

Frank Guinta seems to believe that the rules don't apply to him. He  may be right - he's certainly not being held accountable. 

He repeatedly stated during his 2014 campaign that he was no longer under investigation. 

As Dean Barker has thoroughly researched, that just isn't true.  The FEC investigation into Franks Funny Money is still pending. It's been pending since 2010.. Surely Guinta could have produced a bank statement by now.

At a town hall meeting this past week in Dover, he was confronted by constituent Bob Perry. From Fosters:

One testy exchange occurred toward the beginning of the forum when Bob Perry of Strafford asked Guinta about the Federal Elections Commission investigation into his past campaign spending practices. 

Guinta confirmed the investigation is ongoing but dismissed the initial complaint, brought by state Democrats, as political in nature. 

It wasn't Carol Shea-Porter who was lying. Frank Guinta owes Congresswoman Shea-Porter and all the voters of his district a big, big apology.

It's Almost Over

It’s almost over. A few more political ads ought to help us choose what candidates to vote for. Is there really anyone left who is undecided? Nationwide, over $4 billion is being spent on the midterm elections. Good thing we don’t have anything important we could be spending $4 billion on. The corporate taps are open wide and the dark money is flowing.

Thanks to all that money, we know that Scott Brown knows only one number. 99. We know that he’s attempting to whip white NH into a frenzy about immigration and Ebola. The fear is supposed to divert you from paying attention to why he’s here. He’s here because he lost his Senate seat in Massachusetts, and he’d like to use NH as a springboard to higher office. I’ve been to debates and forums where Brown spoke, and his ground support is thin. What can anyone say about him? He’s never done anything in NH except vacation and run for office. Brown grew up in Massachusetts, went to school there, was married and had a family there, had a career there, got into politics there. If Elizabeth Warren hadn’t beaten him, he’d still be there. The first time Scott Brown casts a vote here it will be for himself.

This is a man who has repeatedly refused to speak with members of the press, going so far as to hide in a bathroom to avoid a reporter. As you ponder his name on your ballot ask yourself this: Should New Hampshire’s US Senate seat be a consolation prize for a guy whose ambition is the only reason he’s here?

Thanks to all the money, we know that Frank Guinta blames Carol Shea-Porter for everything except his toilet training. At the WMUR debate, he was unable to answer even what was presented as a yes or no question without trying to complain about our Congresswoman. He nattered on endlessly about all of the job fairs he had during his single term. I went to 2 of them. The Conway fair was held 2 weeks after a real job fair. The one staged by Guinta was a photo op, and sadly for him, not a single photographer showed up. No one found a job that day, or at any of the other job fairs. If anyone had, they’d be trotted out for display at every opportunity. Frank’s forgotten bank account (the one with the half million he donated to his campaign in 2010) is still being investigated by the FEC. When he ran in 2010, Guinta wailed ceaselessly about CSP’s alleged abuses of the Congressional franking system. He went on to become the number one franking abuser of the 2011-12 Congress.

Guinta learned nothing from being defeated. He still hates gummint, but thinks you should send him back to be part of it. He’s tried to present himself as an independent, bipartisan thinking kind of guy, but that’s not borne out by his voting record, which showed him marching along in party lockstep 96% of the time. Guinta wants to turn the Social Security trust fund over to Wall St. He wants to repeal Obamacare, returning us to those halcyon days of the pre-existing condition, and high cost/high deductable plans that don’t cover much of anything. He is all wound up about Ebola, but doesn’t seem to grasp that public health is a security issue. We should be working to rebuild our once robust public health system.

After listening to a lot of Guinta, it’s clear that he doesn’t have any ideas or plans to move us forward. Frank has only one setting on his gearshift, and that’s reverse.

I was sorry to miss the recent local candidate’s forum, but the write-up in the paper provided such perfect illustration that I could almost hear Frank McCarthy bellowing out his misinformation. Frank is full of “facts,” like the nonsense he spewed about marijuana.  The marijuana law in Colorado does not give free pot to welfare recipients and tens of thousands of potheads are not moving to Colorado. This bellicose purveyor of foolishness should not be given a return ticket to Concord. 

NH is the seventh wealthiest state in the nation, yet we have the 11^th worst infrastructure. Vermont has just about finished wiring their whole state for high-speed internet access. NH has a commission that is still gathering information before acting. Our infrastructure problems, combined with our unwillingness to fund education are the root causes of our economic stagnation. Yet still we hear the same slogans that got us into the mess we’re in taken as some sort of gospel: “NH doesn’t have a revenue problem, NH has a spending problem.” That’s true in the sense that NH is unwilling to raise sufficient revenue to fund our state properly. That’s why we have hundreds of bridges on a red list for structural impairment. Representative Chandler seemed quite comfortable with the fact that we raise insufficient revenue to do the work that desperately needs to be done. Carl Thibodeau is spouting the same old drivel about how to turn the economy around. Union busting won’t magically give NH a 21^st century infrastructure.  Also, guy who dons a Santa suit and stands outside the polls insulting voters might be seen as lacking sufficient gravitas for serving in even our volunteer legislature.

Judging from the reporting on this forum, guns and MOAR GUNZ are the most important issue facing NH. The same people who are desperate to make voting as difficult as possible are living in desperate, scrotum-shriveling fear that gun buyers should have to go through background checks. Mark Hounsell doesn’t seem to think domestic abusers should lose their gun rights. Domestic violence is a leading cause of death in NH. Over 50% of the murders committed in NH between 2001-2010 were related to domestic violence, and over 90 percent of the murder-suicides. Instead of worrying about beheadings in Conway village, Mark would do well to contact Starting Point to learn about domestic violence in NH.

It’s almost over. The calls, the mailers, the surveys will stop for a few months. For now there are still a few days left to research candidates so that we all make informed decisions on Tuesday when we cast our ballots.

In honor of former Congressman Guinta's announcement of his intention to try his luck against Congresswoman Carol Shea-Porter again, let's take a trip in the wayback machine, back to May of 2012:

Frank Pageantry

On Tuesday (May 22, 2012), NH CD-1 Congressman Frank Guinta hosted a job fair in Conway, at Granite State College. A mere 4 days earlier, on May 18, NH Employment Security and Granite State College partnered on a job fair, at the same location. One might be tempted to think that two job fairs in a 4 day span must mean that there is a an abundance of available jobs. One would, of course, be wrong. The Guinta job fair was just another chapter in his re-election pageant. A failed chapter.

In the interest of full disclosure, I didn’t get to the NHES job fair on the 18th, but I did attend the Guintapalooza. I spoke to folks who attended both events. By all accounts, there were 3 times as many vendors at the first job fair, many offering local jobs. There were more attendees, too. I’ll be generous in saying that about 50 people came through the Guinta job fair during the 3-hour period I was there. There were 14 vendors. Of the 14, two were branches of the Granite State college system; one was NHES, nhjobs.com, the Small Business Administration, NH Works, and SCSEP (Senior Community Service Employment Network) a non-profit that helps low-income folks over the age of 55 find jobs. The businesses represented were: US Cellular, Avon, Bankers Life and Casualty Company, efi, Dove Chocolate Home Parties, Personal-Touch Home Health Services, and Aeroflex.

Aeroflex manufactures microelectronic components. They’re located in Londonderry and in Lawrence, Ma. EFI is located in Meredith. They print big stuff, like banners and billboards. Both of these workplaces involve a rather lengthy commute. US Cellular did have jobs available, though mostly in Maine. Banker’s Life was looking for unspecified numbers of people to sell their investment/retirement products. Personal-Touch Home Health Services is a national corporation that provides home health care personnel and services to individuals in their homes. They’re located in Berlin, and trying to gain a foothold in the Conway area. Avon and Dove Chocolate home parties are also available for locals. I watched a number of men walk around the room and leave without speaking to anyone.

The most glaring omission here wasn’t the dearth of actual companies hiring folks. It was far worse than that. There wasn’t a reporter or photographer from any mainstream media outlet there to capture the Congressman as he did a walk-through, and glad-handed the vendors. This was a pageant failure. No bouquet of roses, no sash, no tiara, and worst of all, no photographers.

When I went in, I did tell Guinta’s aide that I write for the Conway Sun, and do some blogging. This was a true statement. I didn’t feel compelled to explain in what capacity my writing manifests itself. The Guinta aides interpreted this as me being a reporter. As Guinta briefly worked the room, another aide approached me and asked if I’d like to speak with the Congressman. Naturally I said I’d be delighted to. The aide asked me a few more questions. When he heard my name, his face froze and he said, “I’ve heard of you.” So much for the opportunity to speak with the Congressman. The aide said Guinta had a meeting with the college president, but he’d be back. Guinta never returned. I only saw him speak with one actual attendee of the job fair.

In March, the Congressman had an event at St. Anselm’s College in Manchester that was billed as the first “Empower, Educate, and Engage Women’s Conference. I was there, with approximately 50 other women. There were a number of photographers and someone doing video recording. Guinta gave a short speech, encouraged us all to reach out to him personally, because he is here to serve the people of NH. Lots of pictures were taken. When the photographers left, so did the Congressman.

The Women’s Conference began with a panel about leadership, and included a rather lengthy discussion amongst the 3 panelists on the “psychology of dressing.” We learned that, as women, we are all leaders. The next panel was comprised of women from the non-profit sector. They were more interesting. The last presenter was a young woman who is the HR director at a corporation. She offered up a lot of information about resumes, interviews, and what to do about gaps in one’s employment history. That was especially important to the attendees. There were some young women there; some obviously students from St. A’s, but the majority of attendees were over 50. I spoke with many of them. Mostly they’re older women re-entering the workplace out of financial necessity. They have sick husbands or family members, they lost their savings when the economy crashed, there were many wrenching stories.

These were women who didn’t need anyone blowing smoke up their skirts about leadership. They’re just trying to stay afloat – and they’re scared. They know that as unemployed people over the age of 50, they have a better chance of getting struck by lightening than finding a good paying job. This conference did little to help the women in that room. It did, however, provide excellent photo coverage for the re-election pageant, which is the sole reason for all of the job fairs.

Congressman Guinta puts out a series of memos called “Frankly Speaking.” In spite of his alleged frankness, he still has yet to adequately explain the magic bank account that funded his 2010 campaign. Frankly Speaking Frank was terribly concerned with Congressional franking privileges during the 2010 campaign. One of his centerpieces was getting his teanut supporters all wound up about Carol Shea-Porter’s alleged abuses of the Congressional franking system. The franking system was created in 1775, and allows Congresscritters to send out mail under their signature, with no stamp or postage. Congress reimburses the Post Office for the franked mail that it handles. Candidate Guinta bemoaned the mailings of our former Congresswoman, and asked, “How is this supposed to help our deficit?”

Given all the caterwauling over the franking, I was shocked to learn that Congressman Guinta spent more than any other member of the House on franked mail. Let’s be frank about Frank’s franking. He sends out big multicolored mailers all the time. He does this, because he doesn’t actually want to meet with constituents. Guinta has chosen to conduct his “town hall” meetings with constituents via conference call. I’m sure you all remember the contentious town hall meetings held in 2010, where teanuts were shrieking at Congresswoman Shea-Porter. It seems likely that the GOP is smart enough to realize that their tactics could easily be turned on them. Guinta’s chosen to eschew events that might provide that sort of potential.

If Guinta had chosen to speak to me, it wouldn’t have changed my mind about how he has served this district. It would, however, have caused me to give him credit for being willing to speak with a member of the alternative/opposition media.

Cry Me a River

In a recent Union Leader opinion piece, former NH GOP Chair Fergus Cullen bemoaned the takeover of his party by  “Tea Partiers, Ron Paul apostles, and fringe figures.” These are the same people that won in 2010, victories Cullen cheered about. The NH GOP threw open the doors to the Tea Partiers, Ron Paul apostles, Free Staters, John Birchers, and wearers of tinfoil berets. They boasted about their great electoral accomplishment. They elected Jack Kimball, a bombastic, bellicose tea tyrant, to be their state party chair.

And soon it all fell apart. That great GOP majority proved to be comprised of inept bumblers and outright lunatics. There was the guy who had to resign for saying that people with disabilities should be sent to Siberia to freeze to death. There were the guys who wrote the bill to include relevant quotes from the Magna Carta in each new piece of NH legislation. There was the Free Stater who wanted to put warning signs up at the NH border. Let us not forget Speaker O’Brien. The list of his follies is long, and includes closing the House gallery to members of the public, and refusing to allow a reporter from a newspaper that had been critical of him into a press conference. This is but a thumbnail sketch of the results of that great majority that the NH GOP crowed about. When Fergus cries his bitter tears about how his party has been taken over by the lunatic fringe, he’d better cry me an entire river. The NH GOP not only allowed this to happen, they welcomed these people. Only now, when they have no chance of winning much of anything in the next election does Fergus get out the crying towel.

The old guard NHGOP must have been absolutely petrified when O’Brien announced he was considering a run against Ann Kuster in the second Congressional District. Poor Obie was not able to raise much money, possibly because he has all of the charm and charisma of a garden slug. He decided (or the party higher ups did) that he’d better drop out. This week, former State Senator Gary Lambert announced he’d be running for that seat. Lambert doesn’t have much name recognition outside of the Nashua area, and his brand of conservatism isn’t likely to be popular in the more liberal of NH’s congressional districts. He’s opposed to marriage equality and does not believe that women are autonomous, equal human beings. At his campaign launch, he said, “Republican ideas work. We’ve proven how they work in New Hampshire.” We have indeed seen how those Republican ideas work in NH. Every day we see our crumbling infrastructure, the death of our manufacturing base, and our high, high property taxes.

In the first Congressional District, Frank Guinta is making noises about a rematch against Carol Shea-Porter. Frank, a Tea Partier who rode the red wave in 2010 would be facing the same questions and ridicule he was ignoring when he was voted out in 2012. He ran on a huff of indignation over Shea-Porters alleged overuse of the House franking system. Frank was outraged about franking! He practically accused Shea-Porter of electioneering. Then, once in office, he became the number one Congressional abuser of the franking privilege, spending double what Shea-Porter had spent during her term.

Then there’s the matter of Frank’s magic bank account. He loaned his first campaign $355,000 that he didn’t have, according to his original financial disclosure forms. He later amended the forms, saying he forgot about a bank account with $250,000 in it. Well, of course he did. Who among us hasn’t forgotten about a quarter of a million dollars? Why it could happen to anyone.  

The Committee for Ethics and Responsibility in Washington (CREW) put Guinta on their 2011 “most corrupt members of Congress” list, which is something of an accomplishment for a freshman legislator. Frank doesn’t just have baggage - he has shipping containers. This time he’ll not only be running against Carol, he’ll be running against himself.

If Guinta doesn’t run, State Representative Pamela Tucker is considering running for that Congressional seat. Tucker was former Speaker O’Brien’s deputy Speaker, and one of his trusted lieutenants. That would be her biggest claim to fame in a district where she has no name recognition.

Rep. George Lambert, a NH native allied with the Free State Project, is exploring a run for governor. He’s definitely part of the “Ron Paul apostle, fringe figure” types that Fergus Cullen is now bemoaning. So far, he’s the only one. He’s another “candidate” with zero name recognition. Where are the candidates with even an iota of gravitas or name recognition? I saw a discussion online among Republicans where Craig Benson’s name was being bandied about as a potential gubernatorial candidate. That’s a subterranean level of desperation right there.

The NH GOP is in disarray, and they have no one but themselves to blame. They not only invited these folks to join them, they allowed them to take over.  To paraphrase the old maxim: “If you lie down with clowns, you will rise with rubber noses.”
